Terms of Use
Please read these Terms of Use ("Terms") carefully before using the KaelSite website (kaelsite.com), mobile application, or any related services (collectively, the "Services").
By accessing or using KaelSite, you agree to be bound by these Terms. If you do not agree, you must not use our Services.
These Terms should be read alongside our other legal policies, which form part of your agreement with us:
- Privacy Policy — how we collect, use, and protect your data
- Cookie Policy — how we use cookies and similar technologies
- Refund Policy — how billing, cancellations, upgrades, and downgrades are handled
- AI Disclaimer — how our AI-powered features work and their limitations
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and Finodax Ltd ("KaelSite", "we", "us", or "our").
2. Description of Service
KaelSite is a mobile-first and web-based platform designed to help construction professionals manage Temporary Works compliance, inspections, issues, reporting, and related documentation in accordance with BS 5975 and CDM 2015.
3. User Accounts
- If you use KaelSite on behalf of a company or organisation, you confirm that you have the authority to do so.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are fully responsible for all activities that occur under your account.
- You agree to provide accurate and complete information when creating an account.
4. Subscription and Payments
- Some features are available under Free, Premium, and Enterprise plans.
- Paid subscriptions are billed through our payment provider (Stripe via RevenueCat).
- Subscriptions automatically renew unless cancelled.
- We reserve the right to change pricing with notice.
- Cancellations, upgrades, downgrades, and refund eligibility are governed by our [Refund Policy] — in summary, payments are non-refundable once a subscription is activated, and any unused balance from a downgrade is credited toward future billing periods rather than refunded.
5. User Content and Data
You retain ownership of all data, inspections, reports, photos, and documents you upload or create ("Your Content"). By using the Services, you grant KaelSite a limited, worldwide, non-exclusive, royalty-free licence to use, host, store, copy, transmit, and display Your Content solely as necessary to provide and improve the Services.
Details of how we collect, use, and safeguard personal data and Your Content are set out in our [Privacy Policy].

8. AI Features
- AI-generated content (reports, explanations, training modules) is provided for informational and assistive purposes only.
- You are responsible for reviewing and verifying all AI-generated content before use.

9. Data Accuracy and Compliance
You are solely responsible for ensuring that all data, inspections, reports, and certificates entered into KaelSite are accurate and compliant with relevant regulations. KaelSite does not provide legal advice.
10. Termination
By us: We may suspend or terminate your account at any time for violation of these Terms.
By you: You may request deletion of your account at any time, in the app or by emailing us. Your account is deactivated immediately and your subscription is set to cancel at the end of the current billing period. You then have a grace period — 14 days, or until your subscription ends, whichever is later — during which you can reactivate your account. After the grace period, your account and data are permanently deleted, except billing records we are required to retain by law. See our [Privacy Policy] and [Help Centre article on deleting your account] for full details.
Effect of termination: on termination by either party, your right to use the Services ends. Provisions of these Terms that by their nature should survive termination (including Sections 7, 9, 11 and 12) will continue to apply.
11. Limitation of Liability
To the fullest extent permitted by law, KaelSite shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Services after such changes constitutes your acceptance of the new Terms.
